HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.10441 OF 2018 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) Both the petitioners are admittedly employees of the Government of India. They have straight away invoked the jurisdiction of this Court without approaching the Central Administrative Tribunal, at the first instance. In the light of the law declared by the Supreme Court in L. Chandra Kumar vs. Union of India and others1, the petitioners are not entitled to straight away invoke the jurisdiction of this Court under Article 226 of the Constitution of India without, in the first instance, approaching the Central Administrative Tribunal.

Leaving it open to the petitioners to approach the Central Administrative Tribunal for redressal of their grievance, the Writ Petition is dismissed. No order as to costs. Miscellaneous Petitions, if any pending, shall also stand closed.
