THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2370 of 2015 ORDER:

The petitioner filed this Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Criminal Procedure Code being aggrieved by the order dated 22.09.2015 passed in by the Deputy Commissioner of Prohibition & Excise, Mahaboobnagar Division, in Cr.No.D2/487/14.

Heard and perused the material available on record. Petitioner herein approached the 2nd respondent seeking to release the crime vehicle i.e., Maruthi Car bearing No.AP 12 H 5444. The 2nd respondent instructed him to submit FDR for a sum of Rs.1,85,000/- (Rupees one lakh and eight five thousand only) from the Nationalized Bank situated in AP in favour of the 2nd respondent. Aggrieved by the same, present revision is filed. Learned counsel for the petitioner submitted that the petitioner is the owner of the vehicle and if the vehicle is kept idle for a long period, there is every possibility of it getting damaged. He further submitted that the petitioner is ready to furnish sufficient personal bond for the said a mount and also produce the vehicle as and when required by the authority concerned.

Considering these circumstances, the petitioner is directed to execute a personal bond for Rs.1,85,000/- (Rupees one lakh and eighty five thousand only) with one surety for the like sum to the satisfaction of the 2nd respondent, in stead of FDR from any Nationalized Bank and the 2nd respondent is directed to accept the bond executed by the petitioner for releasing the vehicle. The other conditions in the impugned order shall remain unaltered.

With the above modification, the Criminal Revision Case is disposed of. Miscellaneous petitions filed in this revision, if any, shall stand closed. ______________ RAJA ELANGO, J October 28, 2015 KTL
