THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3295 OF 2016 ORDER:

This Criminal Petition is filed by A.1 seeking to quash the proceedings in C.C.No.488 of 2011 pending on the file of XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad for the offences under Sections 498-A and 406 IPC and Sections 3,4 & 6 of Dowry Prohibition Act.

Heard the learned counsel for the petitioner and learned Additional Public Prosecutor. Perused the material on record. Learned counsel for the petitioner submits that the petitioner herein is employed in Kingdom of Saudi Arabia and he left India in the month of May, 2010 and he is unaware of the proceedings.

In the circumstances of the case, the petitioner is directed to surrender before the Court below on arrival to India and file an application seeking to recall the warrant issued against him. On filing such application, the Court below is directed to recall the Warrant issued against the petitioner on the same day on execution of a bond by the petitioner for a sum of Rs.1,000/- with one surety with an undertaking for his further appearance for trial before it.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
