HON'BLE SRI JUSTICE S.V.BHATT W.P.No.9288 OF 2015 ORDER:
The petitioner prays for Mandamus declaring the action of respondents in not permitting the petitioner to operate the retail outlet, as illegal and arbitrary. The petitioner further prays for a direction to permit the petitioner to operate the retail outlet without reference to inspection dated 19.02.2015 and letter dated 24.03.2015. The learned counsel appearing for the parties have made detailed submissions in support of the case of respective parties. The admitted circumstance is that the petitioner has made a representation and the same is receiving the attention of respondent Corporation. The learned standing counsel, on instructions, submits that the Corporation considers the issue as per the Marketing Discipline Guidelines and passes appropriate order. The stand of the learned Standing Counsel is placed on record.
The writ petition is disposed of by placing on record the stand of the learned Standing Counsel that the Corporation is considering the issue and within the time schedule, appropriate decision will be taken and informed to the petitioner. There shall be no order as to costs.
