HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.18522 OF 2017 ORDER:

The petitioner claims to be owner and proprietor of 'M/s.Nikhita Natural Seeds and Grain Merchant' situated at Metpally Village and Mandal, Jagtial District. She is doing the seeds business and supplying various types of seeds to farmers for the last ten years. While so, the shop was inspected on 24.05.2017 and a case under Section 6-A of the Essential Commodities Act (the Act, for brevity) was registered against the petitioner on the ground that there is variation in stock. Now the proceedings under Section 6-A of the Act are pending before the second respondent. Though the proceedings are pending for the last three months and when the application of the petitioner for release of the seized stocks was not disposed of, the present writ petition is filed.

Since the regular proceedings are pending before the second respondent, this Court is not inclined to entertain the present writ petition except directing the second respondent to consider the application of the petitioner for release of the seized stocks in accordance with law and pass appropriate orders within a period of fifteen days from the date of receipt of a copy of this order. Further, since three months time has already elapsed in the main proceedings also, the second respondent is directed to conduct enquiry in the proceedings under Section 6-A of the Act and pass final orders after giving opportunity to the petitioner, within a period of three months from the date of receipt of a copy of this order.

The writ petition is accordingly disposed of.
