THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.4723 of 2015 ORDER:
The criminal petition is filed under Section 482 Cr.P.C. to quash the
proceedings in Cr.No.270 of 2015 of Madhapur (Guttala) Police Station, Cyberabad. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor, representing the State. Basing on the complaint lodged by the 2nd respondent/complainant, being forwarded by the concerned Magistrate, the police registered a case against the petitioner/A1 and others for the offences punishable under Sections 420, 471, 323, 506 r/w.34 IPC.
The allegations in the complaint, prima facie, reveal the commission of alleged offences by the petitioner along with other accused. This is a matter, which requires investigation by the police, and there are no valid grounds to quash the First Information Report.
In view of the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting the petitioner/A1 in Cr.No.270 of 2015 of Madhapur (Guttala) Police Station, Cyberabad.
Pending miscellaneous applications, if any, shall stand closed in consequence.
