Heard.

The petitioner states that he is carrying on business of Black Jaggery and Alum in the name and style of M/s.Veerabhadra Agencies. The petitioner states that he has requisite licence and he has been purchasing Black Jaggery and Alum from various customers and selling the same under valid bills. Alleging that the 3rd respondent is interfering with his lawful business activity, the petitioner filed the present writ petition.

Learned Government Pleader has received instructions, which state a case in Cr.No.23/15-16 was registered against the petitioner on 08-04-2015 and the petitioner was arrested and was enlarged on bail. The 3rd respondent states that except proceeding against the petitioner whenever any offence is committed, he has not interfered with the lawful business of the petitioner, Since the criminal case is already registered against the petitioner, it is for the petitioner to defend himself in the said criminal case and in view of the statement of the 3rd respondent that he is duty bound to take appropriate action as per law, in the event of any offence committed, the 3rd respondent cannot be restrained in the manner as sought for by the petitioner. However, his day-to-day lawful business activity shall not be interfered by the 3rd respondent, as recorded above. Accordingly, the writ petition is disposed of. No order as to costs.
