HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25533 of 2006 ORDER:

This writ petition was filed seeking a direction to the respondents to change the alignment fixed pursuant to the notification issued under Section 4 (1) of the Land Acquisition Act on 18.07.2006.

There is no order in favour of the petitioners till today. 3.

A counter-affidavit is filed by the respondents stating that the alignment was fixed by the Engineering department basing on the levels and contours. The acquisition has nothing to do with the alignment. After conducting award enquiry, the Land Acquisition Officer passed the award on 10.10.2006 and also paid compensation to the awardees except the petitioners, who have not accepted the compensation.

Since the present writ petition is filed for changing the alignment, which was fixed by the Engineering people, in the absence of the Engineering department as a party respondent to the present writ petition, no relief can be granted. 5.
