HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.46179 of 2016 ORDER:

This writ petition is filed by the petitioner-A2 under Article 226 of the Constitution of India seeking to quash the proceedings against him in C.C.No.1498 of 2016 on the file of the XI Metropolitan Magistrate, Cyberabad, L.B. Nagar.

Heard and perused the material available on record. 3.
It is stated in the affidavit that the complaint was made against the son of the petitioner alleging that he promised to provide job to the complainant and took amount from him. But he did not provide any job and did not return the amount. The allegations were made against the son of the petitioner. But the police in the charge sheet filed against the son of the petitioner in the above C.C., stated that the father of A1 i.e., petitioner is found absconding and as such, separate charge sheet will be filed against the petitioner as and when traced. Apprehending arrest, the petitioner filed this writ petition.

Considering the facts and circumstances of the case, this Court is inclined to pass the following order:
"The petitioner is directed to surrender before the 2nd respondent herein and execute a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the 2nd respondent. On such surrender and on such surety, the 2nd respondent is directed to release the petitioner and proceed in accordance with law."

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 29th December, 2016 Nn
