THE HON'BLE SRI JUSTICE MUMMINENI SUDHEER KUMAR WRIT PETITION No.17606 of 2022 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. With their consent, this writ petition is disposed of at the admission stage.

This writ petition is filed seeking a writ of mandamus to declare the action of the respondents in not mutating the name of the petitioner in the revenue records and not issuing e-pattadar passbook in respect of land admeasuring Ac.0.16 guntas in Survey No.731/2 situated at Suryapet Revenue Village Shivar, Suryapet Mandal and District, basing on the online application bearing No.LM2200016957, as illegal and arbitrary.

It is the case of the petitioner that her husband, by name, Devineni Venkat Rao, was the absolute owner and possessor of land to an extent of Ac.0.16 guntas in Survey No.731/2 situated at Suryapet Revenue Village Shivar, Suryapet Mandal. The said land was mutated in the name of her husband and his name was also recorded in Dharani portal as pattadar in respect of

the said land. However, after death of her husband, the petitioner is cultivating the subject land without any interruption. Therefore, the petitioner made online application No.LM2200016957 seeking mutation of her name in the revenue records in respect of the subject and also for issuance of e-pattadar passbook. However, the said application is not being considered by the respondents and the same is pending till date.

Admittedly, respondent No.2 is under obligation to consider the application No.LM2200016957 submitted by the petitioner for mutating her name in the revenue records and for issuance of new pattadar passbook in respect of the subject land.

Since the name of the petitioner's deceased husband is reflecting in Dharani portal as pattadar in respect of the subject land, the writ petition is disposed of directing respondent No.2 to consider the online application No.LM2200016957 submitted by the petitioner seeking mutation of her name in the revenue records and for issuance of e-pattadar passbook in respect of land admeasuring Ac.0.16 guntas in Survey No.731/2 situated at Suryapet Revenue Village Shivar, Suryapet Mandal and

District, and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order by assigning due reasons in support of the said decision and communicate the same to the petitioner. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
