THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2528 OF 2016 ORDER:
This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in FIR No.630 of 2015 on the file of Panjagutta Police Station, Hyderabad, for the offence punishable under Sections 408, 420 and 506 r/w 34 IPC.
Heard and perused the material available on record. It is alleged that the 2nd respondent-de facto complainant, who is doing the business of Trading Scrap Diesel Generators in the name and style of ORBIT INFRATECH at Somajiguda, Hyderabad, purchased the Diesel Generators from Indus Towers as per two contracts under value receipt and the Diesel Generators were kept at shed in Erragadda in rental premises and the petitioner, who is an employee under the 2nd respondent, had stolen some DGs from the shed and sold them. When the 2nd respondent removed the petitioner, he promised to hand over all the DGS. But he did not do so. Further, the petitioner threatened the 2nd respondent with dire consequences.
It is the case of the petitioner that he has not committed any offence and that one of the partners of the Orbit Infra Tech viz., Mohammed Siraj Ahmed executed General Power of Attorney in favour of the petitioner by representing him as a Partner of Orbit Infra Tech situated adjacent to Yashoda Hospital, Somajiguda and as per the terms and conditions of General Power of Attorney, the petitioner is managing the affairs of the company and due to the personal grudges developed between the petitioner and the 2nd respondent with regard to the finance, the 2nd respondent made a false complaint.
The points raised by the learned Counsel for the petitioner require investigation. This Court is not inclined to interfere with the investigation in the above crime and therefore, the petition is liable to be dismissed. Accordingly, the Criminal Petition is dismissed. Consequently, miscellaneous
