After generating enough debate at the Bar, Sri N. Aswartha Narayana, learned counsel for the petitioner, has realized the utility of preferring an Appeal to the District Collector against the orders dated 26-08-2014 passed by the Project Director, District Water Board Agency, Anantapuram District. The reason assigned for not preferring any such Appeal within the 30-day period provided therein is that the orders dated 26-08-2014 are realized to be erroneous by the Project Director himself and hence, he has allowed the petitioner to be continued in service.

Be that as it may, let the petitioner prefer an Appeal before 30-04-2015 and if any such Appeal is preferred to the District Collector, Anatapur, the same may be dealt with strictly in accordance with law within a maximum period of three months thereafter and the same may not be rejected only on the ground of not preferring the said Appeal within the 30-day time-frame from 26-08-2014. It is open to the petitioner herein to bring it to the notice of the District Collector the order passed by this Court in similar cases and as and when any such material is brought to the notice of the District Collector, I am sure that the District Collector will consider it appropriately.

With this, the writ petition stands disposed of at the admission stage after hearing Sri M.S.Ramachandra Murthy, learned Standing Counsel for the M.G.N.R.E.G.S., Andhra Pradesh, but however, without costs. Consequently, the miscellaneous petitions, if any, stand disposed of. __________________________ NOOTY RAMAMOHANA RAO, J.
