HON'BLE SRI JUSTICE S.V. BHATT C.C. No.1990 OF 2015 ORDER:

Heard Sri Subba Reddy learned counsel for the petitioner and leaned Government Pleader for Land Acquisition. Apropos to the order dated 11.12.2015, the counsel appearing for the respondents places on record Memo dated 03.12.2015 and Memo dated 28.12.2015 and the instructions received by his office vide letter Rc. B.373/1992 dated 18.01.2016 and contends that the orders of this Court are complied with. The counsel for the respondents placed strong reliance upon the written instructions received by him which read thus: " In view of the above, I request you to appraise the above facts to the Hon'ble High Court on 22.1.2016 and as per the orders of the Government Memo No.15222/LA/A2/2013-2015 Dated 03.12.2015 of Water Resources Department and also Government Memo No.35309/196/FMU/WRI/15 Dt.28.12.

2015 of Finance Department, the bill was already prepared and submitted to the Pay & Accounts Office, Nandyal for sanction of amount vide Token No.11125 Dated 06.01.2016. The same amount will be deposited before the Hon'ble Court as soon as credited the amount through online. (Online status copy enclosed)."

From the above, he requests this Court to close the contempt case. Sri Subba Reddy contends that though proceedings have been issued granting the amount but no amount is paid as on date. I have taken note of the objection raised by the counsel appearing for the petitioner. As the proceedings have already been issued and token number is also assigned by the Pay and Accounts Office, Nandyal, I do not see any reason to disbelieve the stand taken by the respondents. Be that as it may, having regard to Memo dated 03.12.2015 and 28.12.2015 and by accepting the statement made by the counsel appearing for the respondents, I am satisfied for the present the contempt case can be closed. It is made clear that if the actual amount is not already paid to the petitioner or further steps as required are not taken, four more weeks' time from today is granted for completing the other formalities. If for any reason, the formalities are not completed and amount is not paid to the petitioner, the petitioner is given liberty to pray for reopening the instant contempt case.
