HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.19733 OF 2016 ORDER:
The writ petition is filed questioning the provisional order dated 17.05.2016, issued by the 2nd respondent directing the petitioner to stop the construction work on the ground the petitioner is making constructions after expiry of one year period which was granted to him on 23.04.2011.
Heard the learned counsel for the petitioner, learned Government Pleader for Panchayat Raj and Sri G. Narender Reddy, learned standing counsel for the 2nd respondent.
It is the case of the petitioner that because of financial stringency, he could not complete the construction within the period granted to him. However, he is in the process of carrying out the construction work as of now with much difficulty. Considering the fact that the petitioner has a right to approach the respondents for revalidating the permission granted earlier which was expired and further considering the fact that the construction is half way through in the facts of the present case, the writ petition is disposed of giving liberty to the petitioner to approach the 2nd respondent and submit an application seeking extension/revalidation/fresh permission, so as to enable him to complete the constructions in the premises within a period of two weeks by following the due procedure prescribed.
The 2nd respondent shall consider the same within a period of eight weeks after receipt of the application from the petitioner. Till such time, the orders are passed on the application of the petitioner, the 2nd respondent shall not interfere with the construction activity that is being half way through by the petitioner.
With the above observations, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
