THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38289 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the 3rd respondent in harassing the petitioner by summoning to the police station and threatening to arrest with regard to Crime No.79 of 2016. Heard and perused the material available on record. The main grievance of the petitioner is that the petitioner is a document writer and he has been implicated as an accused in the above said crime registered by the 3rd respondent on the complaint given by Smt. P. Sunandha, who is the Sub-Registrar of Alur, alleging that A-1 has fraudulently and intentionally and by misrepresenting, she got executed three registered Sale Deeds, dated 07.02.2015, in respect of the land, which she has no right and thereby all the accused persons who are dealt in with the said fraud are liable for punishment. Learned counsel for the petitioner submitted that no specific allegations are made against the petitioner.

Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in Crime No.79 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. The petitioner is directed to execute a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety to the satisfaction of the 3rd respondent as surety for his future appearance as and when required for the purpose of investigation.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
