THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.27072 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondent University in not considering and not passing orders on the application of the petitioners Dated 12.06.2015 for starting Agriculture Polytechnic College despite the petitioners complying with all the requisite requirements as being illegal, arbitrary, unconstitutional and contrary to the University statute and regulations and consequently direct the respondent university to forthwith pass orders on the application of the petitioners Dated 12.06.2015 and accord permission in favour of the 2nd petitioner institution for starting a Agriculture Polytechnic College with Diploma in Agriculture Course."

Heard Sri P. Pandu Ranga Reddy, learned counsel for the petitioners, learned Government Pleader for Higher Education for respondent No.1 and Sri T. Durga Reddy, learned Standing Counsel for respondent No.2, apart from perusing the material available before this Court.

When the matter is called, letter bearing No.6033/V&L Cell/2015-1, dated 25-08-2015 addressed by the Registrar of respondent No.2 to Sri T. Durga Reddy, learned Standing Counsel for respondent No.2 has been placed on record by learned Standing Counsel for respondent No.2.

According to the said letter, M/s.Aadarana Padi Panta Society at Ananthapur has been given accreditation by the University. It is further stated that the accreditation has been given to M/s.Aadarana Padi Panta Society at Ananthapur as it has better facilities and competent than the petitioners herein. It is also stated that the 2nd respondent - University will communicate the order of rejection shortly.

In these circumstances, the writ petition is disposed of, directing the 2nd respondent herein to furnish a copy of rejection to the petitioners herein, within a period of one week from the date of receipt of a copy of this order. It is open for the petitioners to assail the same if they are so advised.

Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
