HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3842 of 2018 ORDER:

This Criminal Petition is filed under Section 482 of Cr.P.C. by the petitioner/A.1 seeking a direction to the trial court to complete trial in C.C.No.73 of 2017 on the file of II Additional Judicial First Class Magistrate, Machilipatnam, Krishna District, expeditiously. Learned counsel for the petitioner would submit that the petitioner got a job in department of Atomic Energy, Government of India, in 2015 and he underwent training in Variable Energy Cyclotron Centre (VECC) at Calcatta under Stipendiary training scheme and he has completed the said training by the end of 2017 and his office issued memo dated 15-12-2017 stating that his absorption will be considered in case he is acquitted in Criminal Case within a period of six months and if he is not acquitted from the Criminal Case within the said period, he may not be considered for absorption.

Learned counsel would thus submit that trial court may be given a direction to complete the trial expeditiously. Learned Additional Public Prosecutor left the matter to the discretion of the court.

Heard the learned counsel for the petitioner and perused the proceedings in Reference No.VECC/Admn./Per-RKM/4339 dated 15th December, 2017 issued by the Government of India, Department of Atomic Energy.

Having regard to the submission of the learned counsel for the petitioner, the trial court is directed to complete the trial expeditiously not later than three months from the date of receipt of a copy of this order.

Accordingly, this Criminal Petition is allowed. As a sequel, miscellaneous applications pending if any, shall stand closed.
