HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3839 of 2018 ORDER:

This Criminal Petition is filed under Section 482 of Cr.P.C. by the petitioners/A.1 to A.7 seeking to quash the proceedings against them in Cr.No.257 of 2017 of Shadnagar Police Station, Cyberabad, Ranga Reddy District.

The allegations of the complaint, in brief are that on 19-5-2017 at about 7A.M., the accused came to the house of the defacto complainant and questioned him as to how he purchased the land and threatened him that they would kill him. Investigation is reported to be pending.

Denying the allegations, learned counsel for the petitioners would submit that almost with the same allegations, the defacto complainant earlier lodged Crime No.513 of 2017 in Shad Nagar Police Station, which was registered for the offences under Sections 447 and 506 IPC and under Section 3 (1) (s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act,2015 against five among the present petitioners and some others. Accused therein filed a Criminal Petition No.2165 of 2018 seeking to quash the proceedings against them and by order dated 22-2-2018, this court directed the Investigating Officer to proceed with the investigation, without arresting the petitioners therein. A perusal of F.I.R.No.513 of 2017 and present F.I.R. would show that there are some similarities between both of them. Having

regard to it, while directing the Investigating Officer to proceed with the Investigation in this matter, he is directed to strictly follow the guidelines of the apex court rendered in ARNESH KUMAR Vs. STATE OF BIHAR (1) and also follow the provision under Section 41-A Cr.P.C. towards the petitioners. In turn, the petitioners shall cooperate with the investigating agency for smooth completion of investigation.

Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending if any, shall stand closed.
