Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. 2.
This Writ Petition is filed alleging inaction by the District Collector, Anantapur District, the 2nd respondent, in not acting on the representation, dated 24.10.2016, submitted by the petitioner. 3.
In the representation dated 24.10.2016, petitioner requested the District Collector to handover the balance land belonging to it. According to petitioner, land to an extent of Acs.10.00 in H.No.4/861 was grabbed by some persons and as early as in the year 1992, the Special Court under Land Grabbing Cases directed to hand over the said land to petitioner. But, so far the said land is not handed over to the petitioner.

Learned counsel for the petitioner now placed on record the application submitted through online to conduct survey in Survey Nos.106/1 and 106/2 of Papampeta Village. A copy of the survey application along with Mee-Seva receipt is now filed with memo dated 04.04.2018.

The Court is also of the opinion that that unless survey is conducted and demarcation is done, question of handing over land to petitioner does not arise. Since petitioner has already submitted application for conducting survey, the Tahsildar, Anantapur Mandal and District, the 3rd respondent, shall consider the application submitted by the petitioner and furnish suitable reply to it as to
whether survey is to be conducted and in the event, the Tahsildar comes to a conclusion that a survey can be conducted, he shall take appropriate steps for conducting survey by putting on notice all the persons concerned who are likely to be affected. The entire exercise shall be completed within three months from the date of receipt of copy of the order.

With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, filed in the Writ Petitions shall stand closed.
