THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.447 of 2016 ORDER:

This criminal petition is filed by the petitioner - accused No.1 under section 438 of the Code of Criminal Procedure, seeking grant of anticipatory bail in Crime No.98 of 2015 on the file of Garividi Police Station, Vizianagaram District, registered for the offences punishable under Sections 420, 506-II I.P.C. read with Section 34 I.P.C.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and perused the material available on record.

The allegation against the petitioner is that he along with others informed the de facto-complainant that he is having a coin which has lot of powers and worth of it is in crores and demanded to pay one crore so as to get the coin and believing their words the de facto-complainant gave an amount of Rs.38,00,000/- on different dates. Thus, the petitioner cheated the de facto-complainant.

Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner - accused No.1.
