HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 12935 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the proceedings dated 11.01.2001 issued by the 2nd respondent refusing to reimburse the amount of Rs.30,763/- and the medical expenses of Rs.15,000/-, as illegal and arbitrary. Learned counsel for the petitioner has contended that though the respondents are bound to reimburse the amount spent by the petitioner towards medical expenses, they have refused to reimburse the amount and therefore prayed that appropriate orders may be passed directing the respondents to consider the claim of the petitioner for medical reimbursement without being influenced by the earlier rejection proceedings dated 11.01.2001.

Learned standing counsel for the respondents has contended that the petitioner was referred to NIMS, Hyderabad for undergoing orthopedic management, but he had taken treatment in Satya Kidney Center on his own accord and, hence, the case of the petitioner was rejected.

This Court having considered the rival submissions made by the parties is of the considered view that the writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents seeking reimbursement of medical expenses, within two weeks from the date of receipt of a copy of this order and upon receiving such representation, the respondents shall consider the same

and pass appropriate orders, in accordance with law, in four weeks thereafter, without being influenced by the rejection proceedings dated 11.01.2001.

With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 17th December, 2018 cbs
