HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.20368 of 2017 O R D E R :

The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ, order or direction, more particularly one in the nature of writ of Mandamus declaring the action of the respondents in seeking to lay new road, deviating from the existing road, through petitioner's land in Survey Nos.191-14/A2, admeasuring 0.42 cents and Sy.No.191-14/A1, admeasuring 0.52 cents, situated at Nayunipalli Village, Vetapalem Mandal, Prakasam District and cutting down the existing trees in the land, without following due process of law, as illegal and arbitrary and consequently direct the respondents not to lay any road in the petitioner's land without following due process of law. 2.

Heard Sri A.Giridhar Rao, learned counsel for the petitioner and the learned Government Pleader for Roads & Buildings and the learned Government Pleader for Revenue and perused the material available on record.

Considering the facts and circumstances of the case, the respondents are directed not to lay new road through petitioner's land in Survey Nos.191-14/A2, admeasuring 0.42 cents and Sy.No.19114/A1, admeasuring 0.52 cents, situated at Nayunipalli Village,

Vetapalem Mandal, Prakasam District by cutting down the existing trees in the land, without following the due process of law. 4.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in the Writ Petition shall stand closed.
