HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32793 of 2016 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is being taken up for disposal at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in not taking action on the application filed by the petitioner on 29.08.2016, as illegal and arbitrary; and consequently direct respondent No.3 to restore the assignment in respect of land to an extent of Ac.1.15 cents in RS No.74/ 9 of Busarajupalli Village, Buttaigudem Mandal, West Godavari District.

3) The grievance of the petitioner is that though he made an application on 29.08.2016 till date no action has been taken on the said application and learned counsel for the petitioner seeks a direction to respondent No.3 to consider his application. 4) The Government Pleader for Revenue submits that if the said application is still pending consideration, the authorities may be directed to consider the said application in accordance with law.

5) Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ

petition is disposed of and respondent No.3 shall deal with the application dated 29.08.2016, in accordance with law, as expeditiously as possible, preferably within a period of eight to ten weeks from the date of receipt of the order, if the same is made and still pending consideration. No order as to costs. 6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
