HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.3323 of 2019 ORDER :
This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, seeking to quash the proceedings in C.C.No.450 of 2019 on the file of XVII Addl. Chief Metropolitan Magistrate, Hyderabad. 2.
Heard Mr.H.Sudhakar Rao, learned counsel for the petitioner-A3, Mr.Mullangi Rami Reddy, learned counsel for the 1st respondent-de facto complainant and the learned Addl. Public Prosecutor representing the 2nd respondentState. 3.
A charge sheet came to be filed against the petitioner/A.3 along with other accused for the offences punishable under Sections 384, 385, 506, 420, 468 and 471 r/w 34 IPC.

During the course of arguments, the only relief sought for by the learned counsel for the petitioner is to dispense with the presence of the petitioner before the trial Court on every date of adjournment.

The learned Addl. Public Prosecutor submits that since the identity of the petitioner is not in dispute, his presence in the above C.C. may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioner/A.3 in
C.C.No.450 of 2019 on the file of XVII Addl. Chief Metropolitan Magistrate, Hyderabad, is hereby dispensed with while permitting him to mark his appearance through his counsel, except on the dates when his presence is specifically required by the said Court.

With the above direction, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
