Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 3.
This Writ Petition is filed seeking to declare the action of the respondents in seizing the tanker lorry bearing No.AP 31-T-5676 of the petitioner, as illegal and arbitrary.
The petitioner is the owner of the tanker lorry bearing No.AP 31-T-5676. The said tanker lorry was seized by the 3rd respondent on 7.1.2015 on the ground that it was used in illegal transportation of HSD and MS. Learned counsel appearing for the petitioner submits that the said tanker lorry was not involved in any such illegal transportation of HSD and MS and it was seized only on suspicion.
The petitioner submitted an application to the second respondent on 13.01.2015 seeking release of the said tanker lorry, pending disposal of the proceedings under Section 6-A of the Essential Commodities Act.
The grievance of the petitioner is that the 2nd
respondent has not passed any orders so far on the said application.
Having regard to the submissions made by the learned counsel on either side, the 2nd respondent is directed to consider and dispose of the application dated 13.1.2015 filed by the petitioner and pass appropriate orders thereon within a period of ten days from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
