Heard learned counsel for the petitioners and learned Assistant Government Pleader Social Welfare.

It is stated by the learned counsel for the 5th respondent that in the counter affidavit at para No.5, it is stated that the 5th respondent has issued the impugned notice inadvertently by mistake and that they have withdrawn the same.

Learned counsel for the petitioner submits that in view of averments in the counter affidavit at paragraph No.5, the cause in the writ petition does not survive for consideration. Recording the submission of the learned counsel for the petitioner, this Writ Petition is dismissed as infructuous. There shall be no order as to costs.
