HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.16724 of 2013 ORDER:
The present Writ Petition is filed challenging the proceedings issued in Rc.No.76/2011/C4, dated:26.3.2013 by the respondent No.1 as illegal, arbitrary, in violation of principles of natural justice and unconstitutional and consequently set aside the proceedings Rc.No.76/2011/C4, dated:26.3.2013 and to pass such other order or orders as this Court deems fit and proper in the facts and circumstances of the case and in the interests of justice.

The petitioner belongs to Scheduled Tribe (YERUKULA) community and is working in Bharat Sanchar Nigam Limited. In pursuance of complaint, respondent No.1 has cancelled the said caste certificate alleging that the petitioner belongs to Tegala caste. That without going into the merits of the case, petitioner's Counsel, on instructions now, submits that petitioner would like to get the matter adjudicate before the appellate authority by filing statutory appeal.

In view of the same, this Writ Petition is disposed of without expressing any opinion on merits giving liberty to the petitioner to file an appeal before appropriate authority and the same shall be considered on merits by giving reasonable opportunity of personal hearing and also by conducting enquiry. However, it is made clear that limitation, if any, will not come in the way while deciding the appeal.
