THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.37423 of 2015 ORDER:

The grievance of the petitioner in this Writ Petition is that the proceedings under Section 6A of the Essential Commodities Act, 1955 (for short "the Act") have been initiated against it and pending the same, the respondents are proposing to dispose of the seized stocks.

2. Learned counsel for petitioner contends that pending disposal of Section 6A enquiry, the seized stocks may not be disposed of and a time limit be fixed for completion of proceedings under Section 6A of the Act. He also contends that the seized stocks are not perishable in nature and the petitioner is ready to furnish third party security for the value of the stocks.

3. The learned Government Pleader for Civil Supplies, appearing for respondents, states that stocks seized from the petitioner are not perishable and that the respondents will complete the enquiry under Section 6A of the Act within two months.

4. Having regard to the said submissions, this Writ Petition is disposed of directing the respondents to complete the 6A proceedings initiated against petitioner within two (02) weeks from the date of receipt of a copy of this order and pending enquiry, stocks seized from the petitioner may not be sold and if the petitioner offers furnish third party security, the respondents may consider for releasing the stocks to petitioner on it's furnishing third party security for the value of the seized stocks.

There shall be no order as to costs.

5. Consequently, miscellaneous petitions pending, if any, shall stand closed.
