THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.35431 OF 2016 ORDER:
This Writ Petition is filed seeking to declare the framing of charges against the petitioner by issuing G.O.Rt.No.593, dated 01.09.2016, as illegal and arbitrary.
2. The case of the petitioner is that while he was working as Sanitary Inspector, by order, dated 22.02.2014, he was appointed as Municipal Commissioner, Bhainsa Municipality, on temporary basis. Vide impugned G.O.Rt.No.593, dated 01.09.2016, he was issued charge memo. He submitted explanation to the same on 13.10.2016. His grievance is that if the said charge memo is not set aside, his promotion to the post of Municipal Commissioner Grade-III will be affected. Hence, the present Writ Petition is filed.

Learned counsel for the petitioner, while reiterating the averments in the affidavit filed in support of the petition, submits that if the impugned charge memo is not set aside and a direction is not given to the respondents to promote the petitioner, his chance to get promotion will be affected.
4. On the other hand, learned Government Pleader submits that the impugned G.O. is only a charge memo and the petitioner has submitted his explanation on 13.10.2016. He further submits that
when charges are pending against the petitioner, he cannot be promoted.
5. The petitioner, except stating that the charges are vague in nature, has not raised any other ground challenging the impugned G.O. Further, as the petitioner has already filed explanation to the charge memo, he can agitate his grievance before the respondents.
6. In view of the same, I am not inclined to entertain the Writ Petition. Since the petitioner submits that his chance to get promotion will be affected, the respondents shall consider the explanation of the petitioner and conclude the proceedings in accordance with law within a period of six (6) months from the date of receipt of a copy of this order.
7. With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. ___________________________ A. RAJASHEKER REDDY, J October 24, 2016.
