THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.10288 of 2018 ORDER:
This writ petition is filed under Article 226 of the Constitution of India requesting to declare the action of respondents 4 and 5 in not conducting investigation into the case in Crime No.42 of 2018 on the file of the fifth respondent-Station House Officer, Addanki Police Station, Addanki Town and Mandal, Prakasam District, as illegal, irregular and contrary to the provisions of the Code of Criminal Procedure, 1973.

I have heard the submissions of the learned counsel for the petitioner and of the learned Government Pleader for Home (A.P.) appearing for respondents 1 to 5. I have perused material record.

Learned counsel for the petitioner would submit that based on the report lodged by the petitioner, the aforestated crime was registered against the sixth respondent for the offences punishable under Sections 447 and 427 of the Indian Penal Code, and that thereafter, there was no progress in the investigation and hence, the present writ petition is filed.

Learned Government Pleader for Home would submit that investigation is already taken up and that it would be completed in due course of time.

Recording the submissions, the writ petition is disposed of directing the fifth respondent to complete the investigation into the aforestated crime as expeditiously as possible and file a final report before the Court of the learned Magistrate concerned by following the due procedure established by law.
