HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.12453 of 2019 ORDER:
With the consent of both parties, this writ petition is being disposed of at the admission stage.
This writ petition is filed seeking a Writ of Mandamus, declaring the inaction of the respondent authorities in paying salary to the petitioner from the month of December, 2018 onwards in spite of his attending duties regularly and repeated requests followed by various written representations dated 05.03.2019, 29.03.2019, 08.04.2019, 10.05.2019, 20.05.2019 and 14.06.2019, as arbitrary, illegal and unjust. Heard Sri A. Dattanand, learned counsel for the petitioner, and Sri Yadav Reddy, learned Standing Counsel appearing for the respondents. It has been contended by the petitioner that since 2011, he has been working as Site Engineer on contract basis with the respondents and, since then, he has been discharging his duties to the best satisfaction of his superiors and every one concerned.
The grievance of the petitioner is that the respondents have stopped paying salary to him from December, 2018 in spite of his discharging duties regularly. The petitioner submits that he has been making oral requests and also submitted written representations on 05.03.2019, 29.03.2019, 08.04.2019, 10.05.2019, 20.05.2019 and 14.06.2019 requesting the respondents to pay salary to him, but so far the respondents have neither passed any orders on the said representations nor paying salary to him.
Therefore, learned counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents
to consider the representations submitted by the petitioner and pass appropriate orders in accordance with law.
Learned Standing Counsel appearing for the respondents had submitted that the case of the petitioner will be considered and appropriate orders would be passed on the representations submitted by the petitioner. This Court, having considered the submissions made by learned counsel for both parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations submitted by the petitioner and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
With the above observations, the writ petition is disposed of. No order as to costs.
