HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 39618 of 2012 Order:
This Writ Petition was filed challenging the action of the fourth respondent in trying to dispossess the petitioner from her agricultural land admeasuring Ac.3-01 gts., comprised in Survey No.209, situated at Kuknoorpally village, Kondapaka Mandal, Medak District.
2. When the matter is taken up for admission, learned Government Pleader, on the basis of written instructions, submits that the husband of the petitioner was involved in Crime Nos.215 of 2012 and 34 of 2013 and the husband of the petitioner along with other accused was arrested and granted bail. After completion of investigation, charge sheet was filed before the learned Judicial Magistrate of First Class, Siddipet, on 28.02.2013, vide CC No.86 of 2013, and the case is under trial. Learned Government Pleader has produced before me the copy of instructions, a portion of it reads as follows. "The allegation in para-6 that the 4th respondent directed the petitioner to vacate her land as he got directions from respondents 1 to 3 failing which she has to face dire consequences is not correct and hence denied.
It is false to state that the 4th respondent every day calling the petitioner to the police station and detaining her and trying to dispossess her from her land. It is false to state that the 4th respondent is abusing his power. It is submitted that the 4th respondent is not interfering in civil disputes and not summoning the petitioner to the police station as alleged."
3. In view of the same, no case is made out for the relief sought in the present Writ Petition.
The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.
4. As a sequel thereto, the miscellaneous petitions, if any, pending
in this Writ Petition shall stand closed.
