THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.10426 OF 2018 ORDER:

Though this writ petition is filed seeking various reliefs, at the time of hearing, learned counsel for the petitioner would submit that the main relief claimed in the writ petition is to direct the fourth respondent to consider the petitioner's representation, dated 24.02.2018, and pass appropriate orders on the said representation.

I have heard the submissions of the learned counsel for the petitioner and the learned Government Pleader for Ports and Shipping Department appearing for the fourth respondent. I have perused the material record. 3.

Learned counsel for the petitioner brings to the notice of this Court various averments made in the writ petition and the terms of the partnership deed between the petitioner and other partners i.e., unofficial respondents 5 and 6 and would inter alia submit that the seventh respondent is not a partner of the firm and has nothing to do with the firm and that the unofficial respondents have no right to seek permission for the Tug Kalindi, to run in the Sea under the name and style 'M/ s.Sambulingam Marine Services' and therefore, the writ petition is filed. He would further submit that expressing the grievances, the petitioner submitted a representation, dated 24.02.2018, to the Port Officer, Kakinada, i.e., the fourth respondent and that no orders are passed on the said representation.

Learned Government Pleader would submit that the matter is purely an internal dispute between the petitioner and others, who are stated to be partners of a partnership firm and that the Port Officer has nothing to do with such private disputes between the said parties and that the writ petition is not

maintainable as the petitioner has to resolve the disputes with his partners before appropriate forum.

Recording the submissions, this writ petition is disposed of directing the fourth respondent to consider and dispose of the representation, dated 24.02.2018, of the petitioner as expeditiously as possible and preferably within a period of three weeks from the date of receipt of a copy of this order, however, in strict accordance with the procedure established by law. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be o order as to costs.
