HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No. 15757 of 2016 ORDER:

This writ petition is filed to declare the inaction of the 2nd respondent in not disposing of the miscellaneous petition filed along with the main appeal in File No.F1/989/2016 pending on its file as illegal and arbitrary and consequently to direct the 2nd respondent to dispose of the miscellaneous petition without further delay. Learned counsel for the petitioner says that the petitioner filed appeal under Section 24 of Andhra Pradesh (Telangana Area) Abolition of Inams Act, 1955 and also filed Miscellaneous Petition and the appellate authority returned the appeal vide Memo No.F1/989/2016, dated 24-03-2016 and the petitioner has complied with all the objections in said Memo.

Inspite of that no orders are passed. He also submits that in the earlier Writ Petition No.9910 of 2016, this Court directed the 2nd respondent to dispose of the appeal itself within a period of (12) weeks from the date of receipt of order. In view of urgency, the petitioner filed Miscellaneous petition.

In view of the facts and circumstances, if the petitioner has complied with the objections raised by the appellate authority in Memo No.F1/989/2016, dated 24-03-2016 and 2nd respondent is satisfied about the same, the 2nd respondent shall dispose of Miscellaneous petition said to have been filed by the petitioner in accordance with law. With the above direction, the writ petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
