THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8719 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ order or direction more in the nature of writ of Mandamus, declaring the action of the respondents in not restoring the land admeasuring Ac.9-08 guntas forming part of Sy.No. 89, situated at Kothur village, Boothpur Mandal, Mahabub Nagar District to the petitioner by cancelling the registered sale deed document bearing No.

8223/2015 dt:

9-11-2015 got executed pursuant to the G.O.Ms No. 123 dt: 3072015 and the Proceedings dt: nil -10-2015 under reference No. G1/3089/2015 passed by the 2nd respondent, as wholly illegal, unjust enrichment, and unconstitutional besides violation of principles of natural justice and consequently direct the respondents to restore the land to the petitioner and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

In the present writ petition, petitioner is obviously seeking cancellation of the registered sale deed bearing document No.8223/2015, dated 09.11.2015, executed by the petitioner herein in favour of the respondents. 3.

In exercise of the powers conferred under Article 226 of the Constitution of India, this Court cannot exercise such

AVSS,J W.P.No.8719 of 2017 jurisdiction to set aside the registered sale deeds. However, it is open for the petitioner herein to approach the appropriate forum of law for redressal of his grievance.

With the above observation, without expressing any opinion on merits and demerits of the matter, this writ petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
