Petitioners succeeded before the trial Court in partition suit bearing O.S.No.43 of 2002 on the file of Senior Civil Judge, Kavali, which was confirmed by the first appellate Court in A.S.No.179 of 2007 on the file of V Additional District Judge, Nellore. Against the orders of the first appellate Court, second appeal is filed before this Court and the same is pending consideration. At this stage, though initially properties were included in the disputed register, subsequently they were deleted from the disputed register.
Petitioners now apprehend that respondents are trying to alienate the said properties and in such an event, grave prejudice would be caused to them. Representation was made on 29.08.2009 to the Mandal Revenue Officer, Varikuntapadu Mandal, requesting to include the properties in the disputed register. Alleging inaction on the said representation and there was a threat of alienation by the opponents, this writ petition is filed.

Since petitioners have already made representation, in accordance with Rule 32 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Rules, 1989, the Tahsildar, Varikuntapadu Mandal, is directed to examine the claim of the petitioners and take appropriate action as warranted by law, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order. Writ Petition is disposed of accordingly. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
