HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 37762 of 2013 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus to declare the action of the respondents in treating the petitioner's date of birth as 13.11.1961 instead of 17.01.1972 as illegal and arbitrary; and consequently direct the respondent to continue the petitioner in service upto 31.01.2032 duly granting all other consequential benefits, such as, continuity of service and other attendant benefits.

2) Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to consider the representation dated 02.01.2013 made by the petitioner seeking correction of date of birth from 13.11.1961 to 17.01.1972.

3) Learned Standing Counsel for the respondents submits that if the said representation is still pending consideration, the authorities may be directed to pass orders in accordance with law. 4) Having regard to the above, the writ petition is disposed of directing the second respondent to pass orders on the representation dated 02.01.2013 made by the petitioner seeking modification of the date of birth as expeditiously as possible within a period of six (06) weeks from the date of receipt of a copy of the order. There shall be no order as to costs.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
