Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner was appointed as fair price shop dealer of shop No.21 of Valluru village, Tanguturu Mandal, Prakasam District. The authorization of the petitioner was valid upto 31.3.2015 and he deposited the challan on 24.03.2015 for its renewal. While so, the Revenue Inspector, Tanguturu inspected the shop of the petitioner on 12.01.2015 and 31.01.2015 and found some variations in the stock and he submitted a report to the 4th respondent, who in turn, sent a report to the 3rd respondent. Thereafter, based on the said report, the 3rd respondent issued a show cause notice to the petitioner on 07.02.2015.
In response to which, the petitioner submitted an explanation on 16.03.2015.
An order was passed by the 3rd respondent on 04.07.2015 suspending the authorization of the petitioner. Challenging the said order, the petitioner preferred an appeal along with a stay application to the 2nd respondent. As the said appeal is not considered and disposed of, the present writ petition is filed.
Since the appeal is pending before the 2nd respondent against the order of suspension dated 04.07.2015 passed by the 3rd respondent, this Court is not inclined to interfere with the appeal at this stage. However, the 2nd respondent is directed to consider the appeal preferred by the petitioner and dispose of the same within a period of ten days from the date of receipt of a copy of this order, as the appeal
was directed against the suspension only.
With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed. _________________________ A.RAMALINGESWARA RAO, J Date: 16.07.2015 Note: Issue cc in three days siva
