THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.12497 of 2019 ORDER:

This writ petition is filed with the following prayer: "... to issue a writ order or direction more particularly, one in the nature of Writ of Mandamus, to the Respondents No.2 to 4 to protect the Open Space Lands admeasuring 955.55 Sq. yards and other open spaces in Sy.No.29 & 30, situated at Sogbowli, R.R.District from the illegal encroachment of Respondent No.5 and direct the Respondent No.2 to 4 to act upon the representations dated 08-05-2019, further to declare the inaction of Respondents No.2 to 4 on the said representations as illegal and arbitrary and to pass ..." 2.

Sri R.Sridhar, learned counsel for respondent No.5, on instructions, fairly submits that respondent No.5 is ready to hand over the subject property to respondent Nos.2 to 4. 3.

Recording the said submission, the writ petition is disposed of directing respondent Nos.2 to 4 to take over the possession of the subject property from respondent No.5, as respondent No.5 agreed to handover the said property within a period of two weeks. After taking the possession of the said property, respondent Nos.2 to 4 are obligated to earmark/create a public park in the subject property. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
