HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.6061 of 2015 ORDER:
The present petition is preferred by the petitioner challenging the order dated 22-06-2015 in Crl.M.P.No.1522 of 2015 on the file of the Hon'ble Special Judge for Economic Offences-cum-VIII Additional Metropolitan Sessions Judge at Hyderabad, whereby the trial Court while granting bail, directed the petitioner herein to pay the tax amount of Rs.3.56 crores to the Government Treasury, since the petitioner's son filed Memo before the Court that he is ready to pay the said amount and also he produced a D.D. for Rs.50 lakhs on the date of granting bail.
Considering the undertaking given either by the petitioner or by the counsel for the petitioner, the trial Court has passed the said order.
The trial Court has not discussed the merits of the case. Hence, this Court is of the view that it is just and proper to remit the matter to the Court concerned to consider the bail application on merits, since the petitioner is now taken a stand that such undertaking was given on those circumstances, since the petitioner should not languish in jail for a long time. Hence, the matter is remitted to the Court of the Special Judge for Economic Offences-cum-VIII Additional
Metropolitan Sessions Judge at Hyderabad and the trial Court is directed to dispose of the application on or before 10-07-2015. Until the order is passed by the trial Court, the direction given by the trial Court to the petitioner herein to pay the tax amount of Rs.3.56 crores to the Government Treasury within two weeks i.e., on or about 06-07-2015 is suspended.
Accordingly, the Criminal Petition is disposed of. _________________ RAJA ELANGO, J.
