THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.26839 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the 4th and 3rd respondent in trying to take away the custody of petitioner's children from the petitioner without following due process of law and by foisting false cases and consequently direct the 3rd respondent not to take away the custody of the children of the petitioner without following due process of law." Heard Sri N.V.R. Amarnath, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.

The Station House Officer, II Town Police Station, Kurnool has filed a counter-affidavit denying the allegations that the 4th respondent is trying to foist false cases by influencing the 3rd respondent and trying to snatch away the children from the custody of the petitioner without following due process of law. The counter denies the said allegation as false and baseless. On noticing the said averments in the counter-affidavit it is requested by the learned counsel for the petitioner to close the writ petition by recording the said averments.

In view of the above submission, the writ petition is closed recording the above-mentioned averments made in the counteraffidavit of the 3rd respondent.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
