THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI APPEAL SUIT No.832 of 1997 ORDER:
Learned counsel, Sri G.Dhananjai, appearing for the appellant/ plaintiff would submit that despite registered letters addressed to the known addresses of the appellant, he did not respond and, therefore, he has no instructions from the appellant.

Learned counsel filed a Memo stating that there are no instructions from the appellant and that without instructions, it is not possible to proceed in the case and that the registered notices sent to the appellant's two different addresses available in the record could not be served upon the appellant and that one returned postal cover and two postal receipts are submitted to the Court. In the memo, it is finally stated that the counsel may be permitted to report no instructions.

Having regard to the fact that the learned counsel for the appellant has already issued registered notices/letters to the appellant, this Court is of the considered view that there is no need to again order issuance of notices to the appellant through Court before passing further orders.

Appellant is called absent.

In the result, the Appeal Suit is dismissed for default. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
There shall be no order as to costs.
