THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.5500 OF 2008 ORDER:

The writ petition is filed questioning the action of the respondents in not considering the legal notice dated 28.2.2008 and not referring the matter to the appropriate Court as contemplated under Section 30 of the Land Acquisition Act, 1894.

When the matter has come up for hearing, learned Government Pleader for Land Acquisition has placed the instructions received from the Special Deputy Collector, L.A. G.H.M.C, Hyderabad which reads as under:

"The Asst. City Planner, Town Planning Section, Circle No.IV, South Zone, Charminar, Hyderabad vide reference No.86/RW/ACP/C4/SZ/GHMC/2008 dated 4.2.2008, has informed that some of the owners of the properties notified have come forward for negotiation and properties have been taken over U/s.146 duly obtaining the consent from the owners and requested to withdraw the properties including the Writ Petitioner Pre.Nos.18-14-155 from the Land Acquisition Process U/s.48(1) of the Land Acquisition Act." In the light of the above and as the respondents authorities themselves withdrawn the land of the petitioner from acquisition, the writ petition is closed.
