THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION NO.30788 OF 2014 ORDER:

This writ petition is filed under Article 226 of the Constitution of India, for the following relief:

"... to declare the in action of the respondents 3 to 5 in investigating the crime in FIR No.768 of 2009 pursuant to the complaint lodged by the petitioner even though there is a persistent life threat to the petitioner as illegal, arbitrary and consequently direct the respondents 3 to 5 to investigate the aforesaid crime and file final report..."

2. Heard Mr.G.Venkat Reddy, learned counsel appearing for the petitioners and the learned Government Pleader for Home.

When the matter is called today, written instructions, dated 07-10-2015 furnished by the Inspector of Police, Banjara Hills Police Station, Hyderabad have been placed on record by the learned Government Pleader. The said instructions read thus: "It is respectfully submitted that the investigation officer Sri P.Ashok Kumar, Sub-Inspector of Police, PS Banjara Hills, Hyderabad filed the Charge Sheet before the Hon'ble III Additional Chief Metropolitan Magistrate, Nampally, Hyderabad on 14-02-2015 vide S.R.No.1159/2015. The Charge Sheet Xerox copy enclosed herewith for kind perusal."

On noticing the said instructions, it is requested by the learned counsel for the petitioner to dispose of the writ petition by recording the written instructions.

In view of the above, the writ petition is disposed of by recording the written instructions furnished by the Inspector of Police, Banjara Hills Police Station, Hyderabad. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
