ORDER:

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioners who are arrayed as accused Nos.5 to 7 in FIR No.115 of 2026 before the Kothapally Police Station, Karimnagar District, registered for the offence punishable under Section 108 r/w. 3(5) of the Bharatiya Nyaya Sanhita (for short 'BNS').

The case of the prosecution is that the de-facto complainant, lodged a report before the police on 15.03.2026 stating that the marriage between the accused No.2 and the deceased was solemnized about 16 years ago and they were blessed with two children. It was further stated that the accused No.2 was having illegal intimacy with the person, who is residing nearby her house, since then the deceased suffered mentally, keeping the same in min, he has committed suicide, due to the act of accused No.2, the deceased has committed suicide by hanging him to the neem tree on 14.03.2026 and died. Hence requested the police for taking necessary action. On receipt of the said complaint, the Police registered case for the offences as alleged. Aggrieved thereby, this Criminal Petition is filed seeking anticipatory bail of the petitioners. 3.

Heard Sri Ram Prasad Teegala, learned counsel for the petitioners as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners were arrayed as Accused Nos.5 to 7 and there are no specific allegations against the petitioners herein to constitute the offence under Section 108 of the BNS and the specific

allegations are only against accused Nos.1 and 2. Even in the complaint, there is not certain allegations against the petitioners herein and they are ready to cooperate with the investigating authority. Therefore, they prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition. 5.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners, contending that the allegations made against the petitioners herein are serious and grave in nature, as such, the petitioners herein are not entitled for anticipatory bail. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is evident that the specific allegations are primarily against accused Nos.1 and 2. Considering the facts and circumstances of the case and also the role attributed to the petitioners herein, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions:

i.

The petitioners shall surrender before the Station House Officer, Kothapally

Police Station, Karimnagar, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail, on petitioners executing a personal bond for Rs.25,000/- each (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
