THE HONOURABLE MR JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.2637 of 2015
ORDER
Heard learned counsel for the petitioner and learned Government Pleader for Transport (TG).
2. The petitioner's vehicle bearing No.KL09Y3343 was found plying at JNTU, Ranga Reddy District of Telangana State. Vide Vehicle Check Report No.223214, dated 02.02.2015, the Assistant Motor Vehicle's Inspector, Hyderabad points out that difference of Telangana State Tax for Q.E.31.03.2015 was not paid permitting to ply from Guntur District to Telangana State. The vehicle is stated to be kept at Miyapur Bus Depot. Petitioner sought to release of the said vehicle by his application dated 02.02.2015, made to the second respondent, and alleging that no action is taken by the respondents, the present writ petition is filed.
3. Learned Government Pleader for Transport, who has received instructions, states that the vehicle attracts Inter-State District Tax.
4. However, that is a matter for enquiry and determination by the second respondent. In the meanwhile, following the decision of this Court in Saleem Tours and Travels V. Joint Transport Commissioner and Secretary, RTA, Hyderabad[1], the second respondent shall consider the petitioner's application and pass appropriate orders on or before 13.02.2015.
The second
respondent is free to impose appropriate conditions as stipulated in the guidelines prescribed by this Court in the aforesaid decision and thereafter, the second respondent shall conduct enquiry into the matter and determine the amounts, if any, payable by the petitioner.
5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
