HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION M.P.Nos.3295 & 3296 of 2017 IN/AND CRIMINAL PETITION No.1885 OF 2017 COMMON ORDR:

Criminal Petition No.1885 of 2017 is filed by the petitioner - sole accused, under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code'), seeking to quash the proceedings in Crime No.55 of 2017 of Karimnagar-I Town Police Station, Karimnagar, for the offences punishable under Sections 420, 290 and 506 read with 34 of I.P.C.

2. Criminal Petition M.P. No.3295 of 2017 is filed under Section 320(6) of the Code, to permit the de facto complainant to compound the offences alleged.

3. Criminal Petition M.P.No.3296 of 2017, under Section 320 (2) of the Code, is filed by the 2nd respondent/de facto complainant, Sripathi Rajender, along with the Joint Memo, dated 20.04.2017, signed and affirmed by both the parties and their respective counsel, stating that with the intervention of the well-wishers, the matter has been settled and requested to record the compromise.

4. The de facto complainant and the petitioners- accused are present and they are identified by their respective counsel, Sri P.Sajan Kumar, learned counsel for the petitioners, and Sri M.A.Shakeel, learned counsel for the de facto complainant. The parties have produced

ASN,J Crl.P. No.1885 of 2017 Photostat copies of their respective "Aadhaar Cards" in proof of their identity and also attested on the case bundle.

5. On being asked, the 2nd respondent/de facto complainant and the petitioners- accused report that with the intervention of the wellwishers, the matter has been amicably settled.

Since both the parties have affirmed the terms of the Joint Memo dated 20.04.2017 and request to record the compromise compounding the offences against the accused and to quash the proceedings, in view of the guidelines laid down by the Hon'ble Supreme Court in Gian Singh v. State of Punjab1, Criminal Petition M.P.Nos.3295 & 3296 of 2017 are allowed recording the compromise between the parties in terms of the Joint Memo dated 20.04.2017 and compounding the offences against the accused.

Accordingly, the Criminal Petition is allowed, at the admission stage itself, quashing the proceedings against the petitioners-accused in Crime No.55 of 2017 of Karimnagar-I Town Police Station, Karimnagar. The terms of Joint Memo, dated 20.04.2017, entered into by the parties, shall form part of the record.

8. As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
