HON'BLE SRI JUSTI CE CHALLA KODANDA RAM CRI MI NAL PETI TI ON No.3 3 4 6 of 2 0 1 9 ORDER:

This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioner, who is the accused, in Cr.No.27 of 2019 on the file of the Station House Officer, Nadigudem Police Station, Suryapet. The offences alleged are under Sections 324, 504 and 506 of the Indian Penal Code and Sections 3(1)(r)(s) and 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

Considering the fact that the complaint filed by the petitioner herein though was initially not registered but was later registered on the basis of the order of the Principal Judicial Magistrate of First Class, Kodad, this Court is of the opinion that there are cases and counter cases filed by the parties against each other. Hence, in view of the above and considering the nature of the allegations, this Court does not find it a fit case to grant anticipatory bail to the petitioners. 4.

At this stage, the counsel for the petitioners submits that the petitioners would surrender before the Special Judge for trial of Cases under the SCs and STs (POA) Act, Nalgonda and requests this Court to direct the Court below to dispose of the bail application, if any, filed by the petitioners forthwith.

Hence, the criminal petition is dismissed. However, considering the request of the petitioners, the Special Judge for trial of Cases under the SCs and STs (POA) Act, Nalgonda is directed to dispose of the bail petition that would be filed by the petitioners, preferably, on the same day subject to pressure of other work. It is needless to mention that the petitioners shall serve advance notice on the Public Prosecutor appearing in the Court below.
