ORDER

This writ petition is filed seeking to issue a Writ of Mandamus declaring the action of the respondent in not paying the enhanced compensation awarded by the Senior Civil Judge, Vikarabad, in O.P.No.2 of 1999, dated 5.4.2005, as illegal, arbitrary and consequently to direct the respondent to pay the enhanced compensation amount.

The respondent acquired the house sites of the petitioners admeasuring square yards each in Sy.No.148/3, Ward No.3, Block No.2 of Tandur Town, Ranga Reddy District. Thereafter, an Award was passed on 10.10.1997 awarding compensation of Rs.13,626/- to each of the petitioners @ 40/- per square yard and that the petitioners have filed their objections. On 5.4.2005, the Senior Civil Judge, Vikarabad, passed an order enhancing the compensation from Rs.40/- to Rs.400/- along with interest @ 15% p.a. When the respondent failed to pay the enhanced compensation, the petitioners filed E.P.No.39 & 40 of 2005 before the Senior Civil Judge, Vikarabad. Complaining non-depositing of the enhanced compensation, the present writ petition is filed. When the writ petition is taken up for hearing, learned Assistant Government Pleader for Land Acquisition produced

before this Court the letter dated 5.2.2018 addressed by the Revenue Divisional Officer, Vikarabad, wherein it is stated that the entire decretal amount through Banker Cheque bearing No.MBC/CS/448290, dated 14.09.2007 for Rs.6,90,356/- has already been deposited to the credit of E.P.Nos.39 and 40 of 2005 on the file of the Senior Civil Judge, Vikarabad.

In view of the same, the cause in this writ petition does not survive for adjudication.

Accordingly, the Writ Petition is closed. No costs. Miscellaneous petitions, if any pending, shall stand closed.
