ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/A3 seeking to quash the proceedings in Cr.No.1281 of 201516 of Nuzvid Prohibition and Excise Station, Krishna District, registered for the offences punishable under Sections 7(a) r/w Sec.8(e) of A.P. Prohibition Act, 1995 and Sec.34(e) r/w.34(ii), 13(1)(f), 42(c) 50 of A.P.Excise Act, 1968 and Clause (3)(4) of Gur (Jaggery) Regulation of Use Order, 1968, against him.

It is alleged in the complaint that on 25.03.2016, on reliable information, the Excise Sub-Inspector along with his staff proceeded to the house bearing H.No.10/220 situated at Godugulavargudem area, Nuzvid Town, belongs to A1, found white polythin covers with black jaggery and also utensils used for manufacturing the illicit liquor in the back side of the house. Based on the complaint, the aforesaid crime was registered against A1 to A13.

3. In view of the serious allegations made in the complaint and also the nature of proceedings, this Court is not inclined to interfere with the impugned proceedings. However, the concerned police are directed to complete the investigation without arresting the petitioner/A3 and file a final report, if any.

4. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
